TERMS AND CONDITIONS – AERIALHUB

These Terms and Conditions (“Terms”) govern access to and use of the AerialHub mobile application, website and related digital services (“AerialHub”, the “Service”, “we”, “us” or “our”).
By creating an account, purchasing a subscription or accessing or using AerialHub, you agree to these Terms.
If you do not agree with these Terms, you should not use AerialHub.
These Terms should be read together with our Privacy Policy and any additional terms that may apply to specific services or purchases.
1. ABOUT AERIALHUB
AerialHub is a digital platform providing content, resources and services related to aerial sports and related disciplines.
Depending on the subscription or access level, AerialHub may provide features such as educational and informational content, videos, technical resources, codes, directories, events, profiles, uploaded content and other digital tools.
Certain content may be available free of charge, while other content or functionality may require registration or a paid subscription.
The availability of particular functions may vary depending on the user’s subscription, country, device, operating system or application version.
2. ELIGIBILITY AND USE BY MINORS
You must have the legal capacity required under the laws applicable in your country to enter into these Terms.
If you are under the age at which you may legally enter into this agreement independently, you may use AerialHub only with the consent and supervision of a parent or legal guardian where required by applicable law.
Parents or legal guardians are responsible for supervising the use of AerialHub by minors under their responsibility.
Users must provide accurate information regarding their identity and age where such information is required.
3. ACCEPTABLE USE
You agree to use AerialHub only for lawful purposes and in accordance with these Terms.
You must not:
- Use AerialHub for illegal, fraudulent or unauthorised purposes.
- Attempt to gain unauthorised access to the Service, other accounts, servers or systems.
- Interfere with or disrupt the proper operation or security of AerialHub.
- Introduce malware, viruses, ransomware, spyware or other malicious technology.
- Attempt to reverse engineer, circumvent, disable or manipulate security or access-control mechanisms.
- Scrape, extract or systematically collect AerialHub content without authorisation.
- Impersonate another person or misrepresent your identity.
- Use another user’s account without permission.
- Use AerialHub in a manner that infringes the rights of other users or third parties.
- Use content obtained through AerialHub for unauthorised commercial exploitation.
We may take appropriate measures where these Terms are violated, including restricting or suspending access where reasonably necessary.
4. USER ACCOUNTS
Certain AerialHub features require registration.
When creating an account, users must provide accurate, complete and current information.
Each account is personal to the registered user.
Users are responsible for:
- Keeping their login credentials confidential.
- Maintaining the security of their account.
- Not sharing their credentials with unauthorised third parties.
- Informing AerialHub promptly if they believe their account has been compromised.

We may temporarily restrict or suspend an account where reasonably necessary to protect users, prevent fraudulent activity, investigate security incidents or enforce these Terms.
5. THIRD-PARTY SIGN-IN SERVICES
AerialHub may allow users to access the Service using third-party authentication services, such as Apple, Google or other supported providers.
If you choose to use a third-party authentication provider, that provider may process certain information according to its own terms and privacy policy.
AerialHub is not responsible for the independent privacy practices or services provided by those third parties.
Information received by AerialHub through these services will be processed according to our Privacy Policy.
6. SUBSCRIPTIONS
AerialHub may offer paid subscriptions providing access to premium content or functionality.
The subscription price, billing period and relevant conditions will be displayed before the user completes the purchase.
Subscriptions may be offered on a recurring basis.
Unless cancelled before renewal, a recurring subscription may automatically renew for another billing period in accordance with the terms presented at the time of purchase and the rules of the relevant app store or payment provider.
Users are responsible for reviewing the price and subscription conditions before confirming a purchase.
7. APPLE APP STORE AND GOOGLE PLAY PURCHASES
Where a subscription or digital purchase is made through the Apple App Store or Google Play, payment processing is handled by the relevant platform.
Accordingly, billing, renewal, cancellation and refund procedures may also be subject to the applicable app-store terms.
AerialHub does not normally receive or store users’ complete payment-card information for purchases processed through those platforms.
Users who purchased a subscription through Apple or Google should normally manage their subscription through the corresponding Apple ID or Google Play account.
For Apple purchases, Apple’s applicable terms and End User Licence Agreement may also apply.
For Google Play purchases, Google’s applicable terms and policies may also apply.
Nothing in these Terms limits any mandatory consumer rights that cannot lawfully be excluded.
8. PRICES AND PRICE CHANGES
The applicable subscription price will be displayed before purchase.
Prices may vary depending on:
- Subscription type.
- Country or region.
- Applicable taxes.
- App-store pricing.
- Currency.
- Promotional campaigns.
AerialHub may change subscription prices from time to time.
Where required by applicable law or by the relevant app store, users will receive appropriate notice before a price change affecting an existing recurring subscription takes effect.
If a user does not wish to continue following a price change, the user may cancel the subscription before the next renewal, subject to the applicable app-store or payment-provider rules.
9. CANCELLATION OF SUBSCRIPTIONS
Users may cancel recurring subscriptions at any time.
Cancellation normally prevents future renewals and does not automatically terminate access during a billing period that has already been paid.
Unless otherwise required by law or by the relevant app-store rules, access to subscription features will normally remain available until the end of the current paid billing period.
Subscriptions purchased through Apple or Google must generally be cancelled through the user’s corresponding store account.
Deleting the AerialHub application from a device does not automatically cancel a subscription.
Deleting an AerialHub account may also not automatically cancel a subscription managed independently by Apple or Google. Users should therefore ensure that any active store subscription has also been cancelled through the relevant platform.
10. REFUNDS AND STATUTORY CONSUMER RIGHTS
Refund eligibility may depend on:
- The platform through which the purchase was made.
- The circumstances of the purchase.
- Applicable consumer-protection legislation.
- Apple App Store or Google Play refund policies.
Where a purchase was processed by Apple or Google, refund requests may need to be submitted directly through the relevant platform.
Nothing in these Terms excludes or restricts any statutory right to a refund, withdrawal, remedy or reimbursement that applies under mandatory consumer-protection law.
For digital services and digital content, statutory withdrawal rights may be affected once performance or access has begun where the legal requirements for doing so have been satisfied.
11. FREE TRIALS AND PROMOTIONS
AerialHub may offer free trials, promotional prices, discounts or other temporary offers.
Specific conditions for each promotion will be shown when the offer is made.
Where a free trial automatically converts into a paid subscription, this will be indicated before the user subscribes.
Unless cancelled before the trial expires, the subscription may renew at the applicable paid subscription price.
Promotions may be limited to certain users, countries, subscription types or periods.
AerialHub may withdraw or modify promotional offers subject to applicable law and app-store rules.
12. RESTORING PURCHASES
Where supported by the relevant platform, users may be able to restore eligible subscriptions or previous in-app purchases associated with their Apple or Google account.
A restore-purchase option may be provided within the AerialHub application where technically applicable.
Restoration is subject to the rules and technical functionality of the relevant store.
13. INTELLECTUAL PROPERTY
Unless otherwise indicated, AerialHub and its licensors own or lawfully use the intellectual-property rights associated with the Service, including:
- Text.
- Graphics.
- Photographs.
- Illustrations.
- Videos.
- Training and educational materials.
- Databases.
- Software.
- Interface elements.
- Logos.
- Brand names.
- Designs.
- Technical documentation.
- AerialHub’s organisation and presentation of content.
Access to AerialHub does not transfer ownership of this intellectual property to users.
Users receive a limited, personal, non-exclusive, non-transferable and revocable right to access and use the Service for its intended purposes.
Unless expressly authorised, users may not:
- Reproduce or redistribute AerialHub content.
- Record or copy paid or restricted materials.
- Sell or commercially exploit content.
- Publish subscription content on another platform.
- Remove copyright or proprietary notices.
- Create unauthorised derivative works.
- Make protected content publicly available.
- Share paid access with third parties.
14. AERIAL SPORT AND TRAINING CONTENT
Aerial sports, pole sports and related physical activities may involve risks of injury.
Information, demonstrations, videos, technical materials, codes, exercises or other content provided through AerialHub are intended primarily for educational and informational purposes.
Digital content does not replace appropriate in-person instruction, supervision or professional assessment.
Users are responsible for determining whether an activity is suitable for their individual circumstances and should perform physical or aerial activities using appropriate equipment, safety measures and qualified supervision where appropriate.
Users should not attempt skills beyond their ability, training or physical condition.
Where a user has health concerns or doubts regarding participation in physical activity, appropriate professional advice should be obtained before performing the activity.
Nothing published through AerialHub should be interpreted as individual medical advice.
15. SPORTS CODES, RULES AND TECHNICAL INFORMATION
AerialHub may provide competition codes, technical information, judging resources, regulations or similar materials relating to aerial or pole sports.
We endeavour to keep information accurate and useful, but rules and competition requirements may be changed by the organisations responsible for them.
Where participation in an official competition is concerned, users remain responsible for consulting the latest official version issued by the relevant federation, organiser or governing body.
AerialHub does not guarantee that archived or previously published information remains current indefinitely.
16. USER-GENERATED CONTENT
Users may be permitted to upload, submit or publish photographs, videos, text, profile information, comments or other content (“User Content”).
Users retain any ownership rights they hold in their User Content.
By submitting content where publication or sharing forms part of the requested AerialHub functionality, users grant AerialHub the limited rights necessary to host, process, display and technically make that content available for the purpose for which it was submitted.
This permission does not transfer ownership of the user’s content to AerialHub.
Users must have all rights and permissions required to upload or publish the content they submit.
Users must not submit content that:
- Is illegal.
- Infringes intellectual-property rights.
- Violates privacy or image rights.
- Contains unlawful threats or harassment.
- Contains discriminatory or hateful material.
- Contains unlawful sexually explicit material.
- Promotes illegal conduct.
- Contains malicious software.
- Fraudulently impersonates another individual or organisation.
Where appropriate, users should obtain the consent of identifiable persons appearing in photographs or videos before publishing them.
Particular care must be taken with images or information concerning minors.
17. CONTENT MODERATION
AerialHub may review, restrict, remove or disable access to User Content where we reasonably believe that the content:
- Violates these Terms.
- Violates applicable law.
- Infringes another person’s rights.
- Creates a safety or security risk.
- Is fraudulent or abusive.
- Is clearly inappropriate for the Service.
Where appropriate and legally required, users may be informed of moderation decisions and available remedies.
Serious or repeated violations may result in account restrictions or suspension.
18. REPORTING CONTENT OR USERS
Users who believe that content or another user’s conduct violates these Terms may contact:

Where a report concerns unlawful content, intellectual-property infringement, privacy or the safety of a minor, we may request additional information before taking action.
19. THIRD-PARTY CONTENT AND EXTERNAL LINKS
AerialHub may contain links, embedded content or information originating from third-party services.
AerialHub does not control external websites or platforms.
When users leave AerialHub and access a third-party service, that service’s own terms, privacy policy and practices apply.
We are not responsible for the availability or independent content of third-party websites, except where liability cannot legally be excluded.
20. SERVICE AVAILABILITY AND UPDATES
We aim to provide a reliable Service but cannot guarantee uninterrupted availability at all times.
Temporary interruptions may occur due to:
- Maintenance.
- Updates.
- Security measures.
- Hosting or network problems.
- App-store services.
- Technical incidents.
- Circumstances beyond our reasonable control.
AerialHub may periodically modify, improve, replace or discontinue features.
Where a material change affects a paid service, we will comply with applicable consumer-protection legislation and app-store requirements.
21. DISCLAIMER
Information made available through AerialHub is provided for general educational, informational and digital-service purposes.
While we take reasonable steps to maintain accurate information, we cannot guarantee that every piece of information will always be complete, current or error-free.
Users should verify information where accuracy is particularly important, especially in connection with official competition requirements, technical rules, safety or professional decisions.
Nothing in these Terms excludes obligations imposed on AerialHub by applicable law.
22. LIABILITY
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
To the maximum extent permitted by applicable law, AerialHub will not be responsible for losses resulting solely from circumstances outside our reasonable control or from a user’s misuse of the Service.
Users remain responsible for their own conduct, equipment, training decisions and compliance with applicable safety requirements when participating in aerial or physical activities.
For consumers located in the European Union or another jurisdiction providing mandatory consumer protections, these Terms do not affect rights that cannot legally be waived or limited.
23. PRIVACY AND PERSONAL DATA
The collection and processing of personal information through AerialHub is governed by our Privacy Policy.
The Privacy Policy explains, among other matters:
- What information we collect.
- Why we process it.
- How information is stored.
- Data-retention practices.
- Account and data deletion.
- Users’ privacy rights.
- Third-party service providers.
- How to contact us regarding personal data.
Users should review the Privacy Policy before using the Service.
24. ACCOUNT DELETION
Users may request deletion of their AerialHub account and associated personal data by contacting:
Account deletion and personal-data retention will be handled as described in our Privacy Policy and applicable data-protection legislation.
Deletion of an AerialHub account does not necessarily cancel an active subscription purchased through Apple App Store or Google Play. Users should separately cancel any active store subscription where applicable.
25. SUSPENSION AND TERMINATION
Users may stop using AerialHub at any time.
We may restrict, suspend or terminate access where reasonably necessary, including where:
- These Terms have been seriously or repeatedly violated.
- Fraudulent activity is suspected.
- Security is compromised.
- The Service is being used unlawfully.
- Another user’s rights or safety are at risk.
- We are legally required to do so.
Where reasonably possible and appropriate, we may provide notice or an opportunity to remedy the issue.
Termination does not eliminate rights or obligations that arose before termination.
26. CHANGES TO THESE TERMS
AerialHub may update these Terms to reflect:
- Changes to the Service.
- New functionality.
- Legal or regulatory requirements.
- Security requirements.
- Changes in business or technical operations.
The latest version will be made available through AerialHub or its website.
Where required by law, users will be appropriately informed of material changes before they take effect.
Continued use after changes take effect may constitute acceptance where permitted by applicable law.
27. SEVERABILITY
If any provision of these Terms is held to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.
The invalid provision will be interpreted or modified to the minimum extent necessary to make it valid and enforceable where legally possible.
28. GOVERNING LAW AND CONSUMER RIGHTS
These Terms are governed by the laws of Spain, without prejudice to any mandatory consumer-protection rights that users may have under the laws of their country of residence.
Consumers residing in the European Union retain the protections granted to them by applicable mandatory consumer legislation.
Nothing in these Terms requires a consumer to waive a jurisdiction or legal protection that cannot lawfully be waived.
